Gandapur decides to challenge oath-taking by KP governor in court

Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur has decided to file a petition in court against the oath-taking of KP Assembly’s reserved seats members, calling it a violation of the constitution.

In a statement, Gandapur said that taking the oath at the Governor House is a violation of the constitution, adding that article 65 of the constitution is clear that the oath can only be taken on the assembly floor.

The KP Assembly Speaker did not refuse to take the oath, he said, adding that the session was adjourned due to a lack of quorum.

The chief minister said that the Speaker had adjourned the House till July 24.

Administering the oath in the Governor’s House is an unconstitutional act, he said, adding that article 255(2) applies only to (impracticable and impossible) situations.

If the chief minister or the speaker of the provincial assembly refuses, the chief justice can nominate someone, he claimed.

Gandapur further said that the chief minister and the Speaker fulfilled their constitutional responsibility, having called a session of the KP Assembly today.

The government would challenge the oath-taking of reserved seats members at Governor’s House in court, adding that the petition could not be filed today on account of the Sunday holiday.

It should be noted that Khyber Pakhtunkhwa Governor Faisal Karim Kundi on Sunday administered the oath to 25 members of the AP Assembly elected on reserved seats on the orders of the Peshawar High Court.
