Governor KP submits response to PHC on CM’s resignation, oath issue
Khyber Pakhtunkhwa Governor Faisal Karim Kundi has sent his written response to the Peshawar High Court through the Additional Attorney General regarding the resignation of the chief minister and the oath-taking of the newly elected one.
In his reply, the governor stated that he would act strictly in accordance with the Constitution, accepting the chief minister’s resignation and administering the oath to the new one as required by law.
Governor Kundi questioned how a new chief minister could be elected when the incumbent’s resignation had not yet been approved, saying the government had been “engaged in a series of unconstitutional acts.”
He cited a Supreme Court judgment which, he said, required the authority receiving a resignation to verify two things — whether the resignation was genuine and whether it had been tendered under duress. “If given under pressure, such an act could be harmful to democracy,” the governor noted.
Earlier, the Peshawar High Court had directed the Additional Advocate General to ascertain the governor’s availability for administering the oath to the newly elected chief minister.
