Hassaan Niazi challenges military custody and court martial in Lahore High Court

Petition argues May 9 detainee was denied civilian trial; seeks nullification of military proceedings and release order

Pakistan Tehreek-e-Insaf (PTI) founder’s nephew, Hassaan Niazi, on Wednesday challenged his military custody, court martial, and all related proceedings in the Lahore High Court (LHC).

The petition, filed through senior lawyer Faisal Siddiqi, argues that Niazi was never produced before a civilian court after his arrest in connection with the May 9 cases.

Instead, Sarwar Road Police allegedly handed him over to military authorities without lawful authorisation.

Niazi, a PTI activist, has asked the court to strike down the notification dated August 17, 2023, issued by a commanding officer that placed him in military custody.

The plea also seeks to nullify all proceedings conducted by the military court, including the initiation of a court martial.

The PTI leader has requested the LHC to order his release from jail or direct authorities to present him before an anti-terrorism court.
