Senator Ali Zafar warns of constitutional imbalance

PTI’s parliamentary leader, Senator Ali Zafar, on Sunday expressed concerns over the proposed amendments to the Constitution, warning that any imbalance in the constitutional framework could affect the entire governance system.

Speaking in the Senate at length, Zafar said that after the PTI government, numerous violations of the Constitution occurred.

He noted that former Chief Justice Qazi Faez Isa reversed a decision related to Article 63-A, which paved the way for the 26th Amendment.

Zafar alleged that the PDM government passed amendments without securing a genuine majority amid reports that some lawmakers were forced to cast votes.

He also claimed that the JUI-F was deceived and promises made to it were broken, adding that the agreement was altered through the formation of a constitutional bench.

The PTI leader emphasised the significance of the 1973 Constitution, saying it does not belong to any single party or individual but to the entire nation.

He added that any tampering with the Constitution is equivalent to shaking the foundation of the state.

Highlighting Pakistan’s federal structure, Zafar said, “Pakistan is a federal state. Parliament is formed through the people’s vote but remains bound by the Constitution. The Constitution grants citizens fundamental rights, which the judiciary is tasked to enforce. The media serves as the fourth pillar of democracy.”

Zafar also criticised delays in elections, stating that despite Supreme Court orders, elections were not held within 90 days.

He alleged that the PDM government, along with the Election Commission, postponed polls.

Terming the decision to strip PTI of its electoral symbol controversial, he said that the people elected candidates aligned with the party’s founding principles, demonstrating that ultimate power rests with the public.

Meanwhile, former National Assembly speaker Asad Qaiser echoed similar concerns, warning that the Constitution was being “bulldozed” through rushed legislation.

Speaking from Swabi in a video statement, he said that the PP, which takes credit for the 1973 Constitution and the 18th Amendment, now appears to be acting as a facilitator in the latest amendment.

Qaiser claimed that the 27th Constitutional Amendment represents a major conspiracy against the country.

He warned that future judicial transfers by the government could compromise the independence of the judiciary and its ability to deliver impartial justice.
