Former Supreme Court Chief Justice Jawwad S. Khawaja has filed a constitutional petition challenging the proposed 27th Constitutional Amendment, arguing that it unlawfully limits the Court’s powers.

The petition, filed under Article 184(3) of the Constitution, contends that Parliament cannot curtail or transfer the Supreme Court’s constitutional jurisdiction to any other court or forum. It describes the proposed amendment as unconstitutional and invalid.

The petitioner has urged the Court to declare any amendment that reduces its jurisdiction null and void and to assert that the Supreme Court alone has the authority to determine the constitutional validity of amendments.

The petition also challenges provisions related to the transfer of High Court judges and seeks a stay on the implementation of disputed sections of the amendment until the Court reaches a verdict.

According to the petition, granting the Supreme Court’s powers to a Constitutional Court or any other forum would contravene the Constitution and undermine the judiciary’s independence.
